Promotion Terms & Conditions

 

1. The promoter is On Deck Capital Australia Pty Ltd, ABN 28 603 753 215, Level 11, 130 Pitt Street, Sydney NSW 2000 ("Promoter"). This Promotion is conducted online and by email. The Promoter’s website is ondeck.com.au, phone number 1800 676 652 (free call in Australia) and email broker@ondeck.com.au.

 

2. Any broker accredited with the Promoter (except for brokers based in the ACT, Australia) and in good standing (each an “Eligible Entrant”) who, on behalf of a customer, arranges a business loan with the Promoter which is fully funded between 1 July 2024 and 31 August 2024 (both dates inclusive) (“Promotional Period”), shall be automatically entered into in a competition operated by the Promoter. There is no charge for entry into the competition. An Eligible Entrant must be older than 18 years of age.

 

3. Only one entry per business loan arranged by the Eligible Entrant and funded during the Promotional Period is permitted. The entry will be in the name of the Eligible Entrant accredited with the Promoter (not separate individuals) and there is no limit on the number of entries (one loan means one entry).

 

4. The Promoter reserves the right, at any time, to verify the validity of entries and eligibility of Eligible Entrants and reserves the right, in its sole discretion, to disqualify any entry or Eligible Entrant which the Promoter considers, in its sole and absolute discretion to be invalid, ineligible, in breach of these terms and conditions or otherwise jeopardizes the fair and proper conduct of the Promotion. Employees (and their immediate families) of the Promoter are ineligible to enter.

 

5. This is a game of chance, and skill plays no part in determining the winner. The selection will be conducted by representatives of the Promoter. The winners will be selected at random at 12.00pm (AEST) on 4 September 2024 at Level 11, 130 Pitt Street, Sydney NSW 2000. Each Eligible Entrant can only win one prize and should an Eligible Entrant be drawn more than once, the prize will be awarded to the next randomly drawn different Eligible Entrant. The Promoter’s selection of winners in relation this Promotion is final and binding.

 

6. The Promoter will notify the winners by email by no later than 9 September 2024 together with details of how to claim the prize. The winners will be announced on 11 September 2024 by publication on the Promoter’s website. The Promoter’s decision is final and no correspondence will be entered into.

 

7. Three winners will receive a total prize pool valued at $5,000 in prepaid VISA gift cards, drawn randomly (1st: $3,000; 2nd: $1,500; 3rd: $500), in descending order of value with the major prize drawn first.

 

8. A prize, or any unused portion of a prize, is not transferable or exchangeable, and cannot be taken as cash.

 

9. Gift cards will be dispatched by 18 September 2024 without charge to the winner (by post for physical gift cards or email for electronic gift cards, at the absolute discretion of the Promoter). Gift cards are redeemable directly by the winners against VISA and subject to VISA’s terms and conditions from time to time. OnDeck is not liable for disputes between winners and VISA, for lost/stolen gift cards, for any loss as a result of their use, or for any failure to realise their face value for any reason.

 

10. If a winner cannot be awarded their gift card by three months from the original draw after the Promoter has used all reasonable efforts to do so, the win shall lapse and the Promoter shall make another draw randomly as soon as reasonably possible after that date from amongst the non-winning Eligible Entrants, and notify the winner of that prize within 5 days of re-draw and dispatch the gift card within 14 days of re-draw.

 

11. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.

 

12. Acceptance of a prize by a winning Eligible Entrant shall be deemed acceptance of these terms and conditions.

 

13. Nothing in these terms and conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investment Commission Act 2001 (Cth) or similar consumer protection laws in Australia. Except for any liability that cannot by law be excluded, the Promoter (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion or the use of the prize.
